Criminal offenders may be offered to participate in voluntary rehabilitation programs aiming at correcting undesirable behaviour, as a condition of early release. Behavioural treatment may include direct intervention into the central nervous system (CNS). This article discusses under which circumstances voluntary rehabilitation by CNS intervention is justified. It is argued that although the context of voluntary rehabilitation is a coercive circumstance, consent may still be effective, in the sense that it can meet formal criteria for informed consent. Further, for a (...) consent to be normatively valid (“take the wronging out of the act”) under a coercive circumstance, the subject to be treated must (1) have the sovereign authority to consent, and (2) the offer-giver must be in the right normative position to make the offer. While I argue that subjects do have the sovereign authority to consent to treatment, I also argue that inappropriate offers yield invalid consents. Considerations on inappropriate offers should therefore inform which kinds of CNS intervention-based rehabilitation schemes the state may propose as part of the criminal justice system. Yet as I conclude in this paper, while there are some intrinsic constraints on voluntary rehabilitation programs, the main constraints on voluntary rehabilitation are likely to be contingent overriders. However, CNS intervention is not ruled out as such in the context of voluntary rehabilitation. (shrink)

This article represents conversations with the American composer Libby Larsen in which she described her beliefs about music, music education, and the dilemmas that our current system faces as we seek to provide relevant and meaningful music education to our students. Our conversation explores such topics as cognitive psychology, music theory, cultural practices and developments in American culture, and current music education practices. Larsen brought up many questions about music education in America, providing some suggestions for the future (...) and posing problems for which the solution may require a great deal of imagination by music education teachers. The power of algorithms has become a familiar topic in society, media, and the social sciences. It is increasingly common to argue that, for instance, algorithms automate inequality, that they are biased black boxes that reproduce racism, or that they control our money and information. Implicit in many of these discussions is that algorithms are permeated with normativities, and that these normativities shape society. The aim of this editorial is double: First, it contributes to a more nuanced discussion about algorithms (...) by discussing how we, as social scientists, think about algorithms in relation to five theoretical ideal types. For instance, what does it mean to go under the hood of the algorithm and what does it mean to stay above it? Second, it introduces the contributions to this special theme by situating them in relation to these five ideal types. By doing this, the editorial aims to contribute to an increased analytical awareness of how algorithms are theorized in society and culture. The articles in the special theme deal with algorithms in different settings, ranging from farming, schools, and self-tracking to AIDS, nuclear power plants, and surveillance. The contributions thus explore, both theoretically and empirically, different settings where algorithms are intertwined with normativities. (shrink)

–Whether celebratory or critical, STS research on science-industry relations has focused on the blurring of boundaries and hybridization of codes and practices. However, the vocabulary of boundary and hybrid tends to reify science and industry as separate in the attempt to map their relation. Drawing on interviews with the head of a research center in plant biology, this article argues that biology and biotech are symbionts. In order to be viable and productive, symbiosis needs to be carefully managed and given (...) room for divergence within mutual dependence. This process does not take place as the negotiation of a preexisting science-industry boundary. Rather, viability is obtained through a strategy of circumventing the science-industry food chain and sequestering biotech components within the research center. Symbiosis allows academic scientists to do biology while at the same time demonstrating entrepreneurial spirit. (shrink)

Revisionists claim that the retributive intuitions informing our responsibility-attributing practices are unwarranted under determinism, not only because they are false, but because if we are all victims of causal luck, it is unfair to treat one another as if we are deserving of moral and legal sanctions. One revisionist strategy recommends a deflationary concept of moral responsibility, and that we justify punishment in consequentialist rather than retributive terms. Another revisionist strategy recommends that we eliminate all concepts of guilt, blame and (...) punishment, and treat dangerous criminals as we treat people with contagious diseases. I argue against both strong and moderate revisionism that it is not unfair to hold persons desert -entailingly responsible insofar as they take an interest in being treated as appraisable, and that it is unfair to persons not to treat them as desert -entailingly responsible contrary to their interests in being treated as such. The interest-based argument, I conclude, give us a justification for communicating retributive attitudes, but may still require a weak revision of our retributive practices, in the direction of a communicative theory of punishment. ZusammenfassungIm Rahmen des Modellvorhabens „Patienten als Partner—Tumorpatienten und ihr Mitwirken bei medizinischen Entscheidungen“ wurden zwischen März 2002 und August 2003 272 palliativ behandelte Tumorpatienten nach ihrer Einstellung zur Patientenverfügung und zur gewünschten Beteiligung an medizinischen Entscheidungen befragt. Von den Befragten kannten 30% Patientenverfügungen nicht, darunter signifikant mehr Befragte mit formal niedrigerem Bildungsabschluss. Es hatten bereits 11% eine Patientenverfügung abgeschlossen, 22% wollten wahrscheinlich eine abschließen, und 30% wollten keine abschließen. Es fand sich ein statistisch signifikanter Zusammenhang zwischen dem Abschluss einer Patientenverfügung (...) und dem Wunsch nach mehr eigener Entscheidungsverantwortung. Die Einstellung zur Patientenverfügung und der Wunsch nach partizipativer Entscheidungsfindung stehen in keinem statistisch signifikanten Zusammenhang. Patienten mit schriftlichen Vorausverfügungen haben einen erhöhten Kommunikations- und Rückkopplungsbedarf, auf den Ärzte sensibel eingehen sollten. Bei der Information über Patientenverfügungen sollten Menschen mit niedrigerem Bildungsstand mehr als bisher berücksichtigt werden. (shrink)

The notion of quality features prominently in contemporary discourse. Numerous ratings, rankings, metrics, auditing, accreditation, benchmarking, smileys, reviews, and international comparisons are all used regularly to capture quality. This book paves the way in exploring the socio-political implications of evaluative statements, with a specific focus on the contribution of the concept of quality to these processes. The 1948 constitution of the World Health Organization (WHO) defines health as ‘a state of complete physical, mental and social well-being and not merely the absence of disease or infirmity’. It was a bold and revolutionary health idea to gain international consensus in a period characterized by fervent anti-communism. This article explores the genealogy of the health definition and demonstrates how it was possible to expand the scope of health, redefine it as ‘well-being’, and overcome ideological resistance to progressive and (...) international health approaches. The first part of the article demonstrates how the health definition was composed through a trajectory of draft ideas from scholars in the history of medicine, as well as political actors working to promote national health insurance. The definition was authored by League of Nations veteran Raymond Gautier, but secretly drew heavily on medical historian Henry E. Sigerist’s controversial book Socialized Medicine in the Soviet Union (1937). The second part analyses how it was possible to resist the ideological pushback against the WHO and secure US ratification. The WHO’s progressive constitution was not simply a deviation from dominant health ideas, but a direct outcome of the entrenched health conflict. The genealogy is based on original archival material from international organizations and US government archives. The article contributes to understandings of the political controversies surrounding the WHO and to scholarship on understandings of health. It also illustrates how influential health ideas cross the boundaries between politics and health sciences, as well as the boundaries between domestic health policy and global health. (shrink)

Sentimentalist aesthetic theories, broadly construed, posit that emotions play a fundamental role in aesthetic experiences. Jesse Prinz has recently proposed a reductionistic version of sentimentalist aesthetics, suggesting that it is the discrete feeling of wonder that makes an experience aesthetic. In this contribution, we draw on Prinz’s proposal in order to outline a novel version of a sentimentalist theory. Contrasting Prinz’s focus on a single emotion, we argue that an aesthetic experience is rudimentarily composed of a plurality of emotions. We (...) acknowledge and discuss significant problems that follow from such a theory, arguing that a pluralist version of sentimentalism is nonetheless the soundest position within sentimentalist aesthetics. Recent debates in psychopathy studies have articulated concerns about false-positives in assessment and research sampling. These are pressing concerns for research progress, since scientific quality depends on sample quality, that is, if we wish to study psychopathy we must be certain that the individuals we study are, in fact, psychopaths. Thus, if conventional assessment tools yield substantial false-positives, this would explain why central research is laden with discrepancies and nonreplicable findings. This paper draws on moral psychology in order to develop (...) tentative theory-driven exclusion criteria applicable in research sampling. Implementing standardized procedures to discriminate between research participants has the potential to yield more homogenous and discrete samples, a vital prerequisite for research progress in etiology, epidemiology, and treatment strategies. Algorithms are increasingly affecting us in our daily lives. They seem to be everywhere, yet they are seldom seen by the humans dealing with the consequences that result from them. Yet, in recent theorisations, there is a risk that the algorithm is being given too much prominence. This article addresses the interaction between algorithmic outputs and the humans engaging with them by drawing on studies of two distinct empirical fields – self-quantification and audit controls of taxpayers. We explore recalibration as (...) a way to understand the practices and processes involved when, on the one hand, decisions are made based on results from algorithmic calculations in counting and accounting software, and on the other hand, when decisions are made based on human experience/knowledge. In particular, we are concerned with moments when an algorithmic output differs from expectations of ‘normalcy’ and ‘normativity’ in any given situation. This could be a ‘normal’ relation between sales and VAT deductions for a business, or a ‘normal’ number of steps one takes in a day, or ‘normative’ as it is according to the book, following guidelines and recommendations from other sources. In these moments, we argue that a process of recalibration occurs – an effortful moment where, rather than treat the algorithmic output as given, individuals’ tacit knowledge, experiences and intuition are brought into play to address the deviation from the normal and normative. This letter addresses the editorial decision to publish the article, “Research on group differences in intelligence: A defense of free inquiry” (Cofnas, 2020). Our letter points out several critical problems with Cofnas's article, which we believe should have either disqualified the manuscript upon submission or been addressed during the review process and resulted in substantial revisions.

In a crucial passage in the Republic found within a discussion of women’s role in the ideal polis, division of eidē is identified as necessary for dialectic. A careful consideration of the way division is described in this passage reveals that it resembles the procedure of division described in the Phaedrus and the Sophist and that this procedure, when carried out correctly, is central to dialectic according to the Republic and helps set dialectic apart from eristic. Consideration of additional passages (...) in the Republic indicates that division may be employed on different kinds of entities, such as virtues and types of human natures; for according to the argument of the Republic, the correct use of division for the purpose of distinguishing types of human natures or virtues, entities that to the untrained eye may look alike but are distinct by nature, is required for achieving the knowledge philosophers and philosopher-rulers need. In fact, correctly performed divisions help the dialectician to bring into focus a subject matter under consideration in a kind of double-vision that reveals that matter as a concrete phenomenon that exhibits participation in different eidê when it is considered from different points of view. This article takes the stance that the subjectivity of the researcher is an integral part of the research process. It should be studied as a key to understanding the interrelational processes of meaning in an interview situation. The article demonstrates how the subjectivity of the researcher can be made accessible methodologically and methodically by combining a psychodynamic approach with an autoethnographic approach. The methodical question is therefore how the researcher can conduct introspection and at the same time reflect upon and (...) analyse the central object of investigation. The approach is psychoanalytically informed, but autoethnography became the actual vehicle for moving beyond reflections on the psychodynamics represented in the texts. The researcher ventured into an introspection of not only the texts, but also her own feelings, fantasies, and bodily experiences at the time of the interview and also when bringing the data into new situations. The abstract reflections after the interview situation were left for a while, and instead a more experiential and sensual/bodily understanding appeared, based on narratives, feelings, and reflections from the research field. In doing so, the affective and experiential personal process became an important step in the interpretation. (shrink)

The term psychopathy refers to a personality disorder associated with callous personality traits and antisocial behaviors. Throughout its research history, psychopathy has frequently been described as a peculiar form of moral blindness, engendering a narrative about a patient stereotype incapable of taking a genuine moral perspective, similar to a blind person who is deprived of proper visual perceptions. However, recent empirical research has shown that clinically diagnosed psychopaths are morally more fit than initially thought, and the blindness-analogy now comes across (...) as largely misleading. In this contribution, the moral-blindness analogy is explored in an attempt to qualify anew its relevance in psychopathy theory and research. It is demonstrated that there are indeed theoretically relevant parallels to be drawn between blindness and psychopathy, parallels that are especially illuminating when accounting for the potential symptomatology, dimensionality, and etiological nature of the disorder. The Hare Psychopathy Checklist (PCL; Hare, Neumann, & Mokros 2018) scales are among the most widely used forensic assessment tools. Their perceived utility rests partly on their ability to assess stable personality traits indicative of a lack of conscience, which then facilitates behavioral predictions useful in forensic decisions. In this systematic review, we evaluate the empirical evidence behind 3 fundamental justifications for using the PCL scales in forensics, namely, that they are empirically predictive of (1) criminal behavior, (2) treatment outcomes, (...) and (3) a lack of conscience. We found the PCL scales can predict criminal behavior to a statistically significant degree, though with important limitations. We found no evidence of PCL psychopathy being predictive of treatment and rehabilitation outcomes. We found no evidence of PCL psychopathy being predictive of a lack of conscience. These findings disprove widespread beliefs about PCL psychopathy among forensic practitioners and questions the current and future role of the PCL scales in forensic settings. (shrink)

Two hundred years after its publication, The Phenomenology of Spirit (PhS) remains an enigmatic and challenging text, subject to a variety of interpretations. In this paper I seek to open up an additional interpretative space by emphasizing the influence of Hegel’s study of the Bible at the Tübingen Stift (1790–1793) on PhS. In a letter written to Schelling in 1795, Hegel had wondered what it might mean to »draw near to God.« It is the hypothesis of this paper that answering (...) that question was at least part of Hegel’s intent for PhS. John Stuart Mill observed in his Autobiography that he was a rare case in nineteenth-century Britain because he had not lost his religion but never had any. He was a freethinker from beginning to end. What is not often realized, however, is that Mill's life was nevertheless impinged upon by religion at every turn. Artificial intelligence is likely to undermine the anthropocentrism of humanism, the master narrative that undergirds the modern world. Humanity will need a new story to structure our beliefs and cooperation around. As different regions explore posthumanist alternatives through fiction, they bring with them distinct traditions of thought. The Swedish TV series _Real Humans_ (2012–2014) and its British remake, _Humans_ (2015–2018), dramatize the challenge of freeing oneself from cultural presumptions. When negotiating personhood with humanoid robots, the Swedish protagonist family presupposes a (...) social-democratic ethos, which is a trace of Scandinavian humanism that carries into the family’s posthumanist beliefs. Using Heideggerian and related perspectives, I analyze these series to make a case for a _dataist_ ontology with potential to re-enchant the modern world and bring forth a new epoch of being. Such a master narrative of _algorithmic universality_ could be facilitated by a new level of interconnectedness made possible by AI. This ontology fulfills the requirements of Robbins and Horta (Introduction, Cosmopolitanisms. New York University Press, New York, pp 1–17, 2017) who call for a cosmopolitanism of inclusivity with room for overlapping conceptions to remedy our present era’s international dysfunction. The Swedish and British TV series suggest that even if humanity’s uniting around a dataist master narrative were to be driven by intercultural competition, the decisive choice might be out of human hands. Paradoxically, such disempowering in terms of agency is portrayed as necessary for human _re-enchantment_. (shrink)

We define an evolutionary process of “economic Darwinism” for playing the field, symmetric games. The process captures two forces. One is “economic selection”: if current behavior leads to payoff differences, behavior yielding lowest payoff has strictly positive probability of being replaced by an arbitrary behavior. The other is “mutation”: any behavior has at any point in time a strictly positive, very small probability of shifting to an arbitrary behavior. We show that behavior observed frequently is in accordance with “evolutionary equilibrium”, (...) a static equilibrium concept suggested in the literature. Using this result, we demonstrate that generally under positive (negative) externalities, economic Darwinism implies even more under- (over-)activity than does Nash equilibrium. (shrink)

This article explores a question format consisting of `you say' plus a version of what the co-participant has said, which is used to ask for confirmation of something said in an earlier sequence. Questions using this you say x format often request not only confirmation but also accounts and can, on occasions, be taken as challenging the interactional balance, that is, be treated as disaffiliative. The article investigates the sequential, prosodic and grammatical conditions for affiliative and disaffiliative uses of you (...) say x questions and discusses the potential institution specificity of the phenomenon. It is found that the clearly disaffiliative you say x questions are parts of dispreferred and disaligning moves, that they have `marked' prosody, that they raise problems, and that they are most often prefaced by `objecting' particles. Affiliative you say x questions are aligning next sequences in environments where the focus is on information delivery. They have `unmarked' prosody and they contribute to getting information on record. You say x questions which call for accounts without being clearly disaffiliative, are also examined. Even though they often raise problematic issues, they are not sequentially disaligning and have less `marked' prosody than the disaffiliative cases. (shrink)

What degree of justification should be required of epistemological cognition, the kind of cognition by which epistemological problems are to be solved? I consider the question by examining Husserl’s view of the matter. Challenging the current consensus, I argue that he is committed to the infallibility of epistemological cognition. I first present what he takes to be the leading problem of epistemology, which he designates as the ‘problem of transcendence’ or the problem of how ‘transcendent cognition’ is possible. I then (...) give an account of what I call his Non-Transcendence Constraint, on which the problem cannot be solved by means of cognitions of the kind whose possibility it concerns, and so cannot be solved by means of transcendent cognition. Pointing out that he provides four specifications of the problem, I go on to argue that on the most fundamental of these it concerns the general possibility of fallible cognition. By the Non-Transcendence Constraint, however, this entails that the problem of transcendence cannot be solved by means of fallible cognition. I conclude that central aspects of Husserl’s metaepistemology commit him to the infallibility of epistemological cognition, at least as far as solving the supposedly leading problem of epistemology is concerned. In this article, we discuss the practice of conducting research in one's own field, in this case, from a position as a researcher with a nursing background doing fieldwork in a hospital and in one's own organization, an orthopedic surgical department. We show how an “insider” researcher position paves the way for analytical insights about sleep as an institutional phenomenon in the orthopedic surgical infrastructure and how acute and elective patient trajectories differ but build on the same logic, creating the (...) same dynamics of inclusion and exclusion. Through a situated and sociomaterial perspective, we analyze different clinical interactions in which we follow the hospital bed as an example of a central relational element that co‐creates sleep as an institutional phenomenon. Inspired by Karen Barad, we demonstrate how to move diffractively when doing and analyzing fieldwork and argue how moving diffractively as a researcher doing fieldwork “at home” is productive and challenges the concept and demand of “distance” as the phenomenological exercise in fieldwork. We use hyperbolic towers to answer some model-theoretic questions around the generic type in the theory of free groups. We show that all the finitely generated models of this theory realize the generic type $p_{0}$ but that there is a finitely generated model which omits $p^{}_{0}$. We exhibit a finitely generated model in which there are two maximal independent sets of realizations of the generic type which have different cardinalities. Although prisons provide on-site primary care, the corrections system relies on external hospitals to provide a variety of healthcare services. Compared to the general population, incarcerated patients experience higher rates of chronic medical conditions, mental illness, substance abuse, cancer, traumatic brain injury, assault, and communicable disease. Certain specialties of clinicians are likely to encounter patients who are incarcerated, which makes it important for clinicians to understand how medical decision-making may differ when the patient is a prisoner. The corrections system retains (...) custody of inmates and is responsible for their welfare, including facilitating necessary medical care. However, this does not permit corrections personnel or a warden to automatically assume the role of the patient's medical decision-maker. Except for narrow exceptions, prisoners do not lose their rights to medical decision-making. In some instances, corrections staff or the prison warden have improperly asserted authority to act as the patient's medical decision-maker, such as when the patient lacks decision-making capacity. This violates ethical principles of bodily integrity, respect, and fairness. This paper provides an overview of medical decision-making for incarcerated patients, how surrogate decision-maker hierarchies apply to incarcerated patients without decision-making capacity, and special considerations for this subset of patients. Plato often depicts Socrates inquiring together with an interlocutor into a thing/concept by trying to answer the “What is it?” question about that thing/concept. This typically involves Socrates requesting that his discussion partner answer the question, and usually ends in failure. There are, however, instances in which Socrates provides the sort of answer, in relation to a more familiar thing/concept, that he would like to receive in relation to a more obscure thing/concept, thus furnishing his interlocutor with an example of (...) how he would like him to answer. This chapter considers this dialectical tool by focusing on three instances of its use (Meno 73e3–76e4; Laches 191e9–192b3; Theaetetus 146e7–147c6). It argues, first, that in these instances Socrates provides true and adequate definitions of the things/concepts in question. It further argues that dialectic, for Plato, is just as much about the essences everyday things/concepts as it is about the essences of more obscure things/concepts; and that it is just as much about the meanings of the words we use to designate things, as it is about the essences of those things.
